2 Year Guarantee for Materials, Workmanship and Performance
EUROFLEX® Impact Protection Slabs
Subject to the following terms and conditions Gummiwerk KRAIBURG RELASTEC GmbH (referred to hereinafter as "the Seller") hereby warrants to XYZ (referred to hereinafter as"the Buyer") that the EUROFLEX® impact protection slabs (referred to hereinafter as "the Product") supplied to the Buyer will be free of performance defects for a period of 2 years (referred to hereinafter as "the Term of the Warranty").
Beginning Date of the Warranty
In the event the Buyer has commissioned supply of the Product only, the warranty shall commence on the date the Product is delivered to the job site. In the event the Buyer has commissioned supply of the Product and execution of its installation, the warranty shall commence on the date the Product has been completely installed in accordance with the Seller's installation instructions and its intended use.
The following performance characteristics are expressly guaranteed in accordance with this warranty:
1. Surface wear of the Product will not exceed 6 mm per year anywhere on the installed surface, even on frequently impacted areas under slides and swings. This high durability is due to the Product's homogeneous density.
2. The Product will conform to EN 1177 in site testing.
Test results from independent laboratories are available showing that the Product - at impact locations without and with jointing seams - conforms to the requirements of EN 1177 at the fall height specified by the Buyer with his order. However due to variances permitted in EN 1177 and varying site conditions, the actual impact attenuation provided by the Product as installed at the site is an important criterion for the Buyer.
In selecting the Product for a specified fall height, the Seller has included a safety factor making allowance for differences between standard specifications and site performance.
Accordingly, the Seller warrants the Product for the specified fall height performance over the full Term of the Warranty.
It is the responsibility of the Buyer to specify with his order the fall height(s) required at his site (see EN 1177).
Warranty Remedies
In the event of a justified performance defect (nonfulfilment of either of the performance characteristics specified above) the Seller shall fulfil his obligations pursuant to this Warranty by replacing the specific defective areas of the Product.
This warranty covers materials only. All other costs required to effect remediation including freight and installation of the replacement materials supplied shall be borne by the Buyer.
This warranty is not applicable in any of the following cases:
1. If the product has not been maintained properly in accordance with the Seller's specifications. This includes but is not limited to cases in which the product is found to contain foreign material such as bark, dirt, dust, loose sand and the like.
2. If repairs, alterations and/or modifications are made to the installed surface without prior consultation, consent or authorization of the Seller.
3. If during the Term of the Warranty, the Buyer or the owner denies the Seller and/or their representative access to the installed product or fails to cooperate in obtaining permission for this access.
4. If the defect claimed is fully or in part due to the Product not having been installed in accordance with the Seller's installation instructions.
5. If acids or other aggressive substances have been in direct or airborne contact with the Product.
6. If the defect claimed was caused by any act of negligence, abuse, accidents, misuse, vandalism, civil disobedience, criminal acts, war or the like.
7. If the defect claimed was caused by a natural disaster including but not limited to lightning, earthquake, hail, tornado, hurricane or any other Act of God.
8. If the owner fails to comply with all terms and conditions stated herein.
9. If payment for the Product has not been made in full and/or a completed warranty has not been signed, dated and registered by the Seller. Failure on the part of Gummiwerk KRAIBURG RELASTEC GmbH to enforce any of the terms or conditions stated herein shall not be construed as a waiver of such terms or conditions.
This warranty supersedes and takes precedence over any and all other warranties that are in conflict with the terms and conditions set forth herein.
